It's not.  Most states say that passing on the right on a two-way
single lane road is illegal, except for passing a car making a left.

The trick is in the way they word it-- there's one law stating that
passing must be done on the left, and another which makes an exception
for multi-lane roads.  I assume this comes from some model vehicle
code.

In some states (like MD), it IS illegal to pass a car making a left by driving
onto the right shoulder (in other words, you must pass them within
the lane, on a single-lane road) -- yet another law people break every day.
