However, with the way tort law is in the United States, if a person is injured while not wearing sealtbelts (or having an airbag) he can sue and win against the person causing the accident. Even if he didn't take the necessary steps to protect himself/herself from "reasonable harm". My solution is to prevent a person from being able to sue for damages if he doesn't take reasonable precautions to protect him from harm.. At the very least, he should be considered contributorily negligent, with any awards mitigated by the amount of damage caused by not wearing seat belts. mho.... Scott D.
